$100K Offer to $1M Policy Limits
After mediation, the offer sat at $100K before ROE became involved. No brain injury had been diagnosed, and no future care or economic losses were documented. ROE identified the brain injury, arranged neurological and neuropsychological workups, and coordinated vocational, economic, and life care experts. The insurer tendered the full $1 million policy within 10 days of our negotiation letter.

The UIM insurer refused to accept that a hernia was caused by the accident and offered nothing beyond the third party tender. ROE recommended and facilitated a physician IME that established causation and immediately received an offer of $25K on their $30K limits.
Cranio-cervical Instability, not TBI
ROE was brought on 2 years into a claim wherein TBI had been diagnosed on a moderate severity collision, but the insurer refused to make an offer. ROE's review determined craniocervical instability was the more likely explanation for the client's post-concussive type symptoms, and subsequent objective evidence and workup by the right experts confirmed this to be the case and yielded a full $1 million policy tender.
